Rise in prenuptial agreements

Prenuptial agreements are becoming increasingly popular in Illinois and around the country. While this type of arrangement has traditionally been associated with high asset divorce cases, a recent survey by the American Academy of Matrimonial Lawyers has revealed some interesting developments.

Friends and family of divorcées more likely to divorce

Illinois residents may be interested in a recent study conducted by a research team at Brown University. The study concluded that couples with divorced friends or close family members are more likely to divorce than other couples. These results are based on 30 years worth of data collected from the residents of a town in Massachusetts.

Marital assets and property division

Illinois residents considering a divorce know that one of the major issues they will have to deal with is dividing up property, but some people are unaware of just how many different forms and types of assets they actually own. In a high asset divorce, there are likely to be a number of complicated items that need to be accounted for well beyond the basic bank accounts and house. It is important that couples are aware of the property they share to be sure that they ask for their fair portion of these assets.

Tips for the divorce mediation process

Sometimes, Illinois couples are able to navigate the divorce process through mediation, especially if they get along with each other. However, even though situations may vary, there are certain guidelines professionals suggest people follow in order to help the process. The most important goal of divorce mediation is to move people away from their positions and explore the reasons why those positions are held. Once all parties understand those reasons, most agreements tend to come together.

Divorcing without litigation

Illinois couples planning to get a divorce might be wary of the emotional and financial stress that such a process can bring. Divorce not only affects the spouses themselves, but their loved ones as well. However, some of the negative effects of divorce may be reduced if couples can reach a negotiated agreement without going through litigation.
